SERVICE TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS AND SERVICE AGREEMENT

Reconsyl Media t/a Mas Leon Photography ("The Studio," "We," or "Us") provides professional production services. By confirming any booking, You acknowledge and agree to be bound by these Terms. This Agreement is legally binding and governed by the laws of Zimbabwe.

2. ALL RIGHTS RESERVED

The Studio reserves all rights not expressly granted in these Terms. We maintain full ownership and discretionary control over our brand, facility usage, and the standards of content produced within our premises. Any unauthorized use of our name, facility, trademark, or intellectual property is strictly prohibited.

3. RIGHT OF REFUSAL AND ADMISSION

The Studio operates as a discretionary production facility. We reserve the absolute right to refuse service, terminate ongoing projects, or deny access to any individual or entity at our sole discretion. Such decisions may be based on, but are not limited to, a lack of alignment with our internal strategic direction, brand integrity standards, or operational mission. The Studio is under no obligation to provide detailed justification or exhaustive disclosure regarding its internal vetting and selection processes.

4. NON-ENDORSEMENT AND INDEMNIFICATION (LEGAL DISCLAIMER)

• Non-Endorsement: The views, thoughts, and opinions expressed by Clients, their guests, or participants during the use of our facility belong solely to the Client and do not necessarily reflect the views, official policy, or position of Mas Leon Photography. Hosting a project does not constitute an endorsement or agreement with the content produced.
• Indemnification: The Client agrees to indemnify, defend, and hold harmless Reconsyl Media, its directors, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including attorney’s fees) arising from:

1. The content produced within the studio (including claims of defamation, libel, or copyright infringement).
2. The Client’s use of the studio facility.
3. Any third-party legal action resulting from the public broadcast or distribution of content recorded at the Studio.

5. BOOKING, VALIDATION, AND PRODUCTION PROCESS

The Studio follows a structured production workflow to ensure quality and brand alignment.

• Step 1: Creative Briefing: All projects begin with a mandatory Creative Briefing. The Client must disclose the show’s theme, guest list, and primary goals to ensure alignment with our studio standards.
• Step 2: Validation: A booking is validated only when the Client has signed this Agreement and a non-refundable, non-transferable Deposit of 50% has been received.
• Step 3: Pre-Production & Asset Submission: All branding assets (logos, intros, lower thirds) must be submitted 48 hours before recording.
• Step 4: Recording Session: Upon arrival, the studio is prepared based on the Creative Brief. Recording commences at the scheduled time.
• Step 5: Balance & Delivery: The remaining 50% balance is due upon delivery of final content. No final files will be released until the balance is settled in full.

6. CANCELLATION AND RESCHEDULING POLICY

• Cancellation: If You cancel, the Deposit is forfeited. Cancellations made less than 48 hours prior to start time incur liability for the full balance.
• Rescheduling: We prefer that rescheduled sessions take place within seven (7) days of the original date. If the Studio is unavailable within that week, the session must be rebooked for the earliest available opening. Under no circumstances is a rescheduled session permitted to pass the six (6) month mark from the original date. Failure to record within this 6-month window results in the automatic forfeiture of the Deposit or any payments made.

7. CONTENT STANDARDS AND PENALTIES

• Wholesome & Pure Media Policy: All content must adhere to professional standards of decency and the guidelines of the Broadcasting Authority of Zimbabwe (BAZ). To us, wholesome content is constructive, respectful, and dignified. It informs or inspires without resorting to vulgarity, derogatory language, or high-conflict debates.
• Prohibited Content: We strictly prohibit gratuitous profanity, vulgarity, derogatory language, or high-conflict debates that compromise our brand integrity.
• Termination: If these standards are violated during a session, the Studio reserves the right to immediately terminate the recording without refund.

8. PRODUCTION, COPYRIGHT, AND LIABILITY

• Editorial Judgment: We retain the right to use professional discretion in editing and selecting takes.
• Copyright: The Studio retains ownership of all raw footage until the final balance is paid. Upon payment, the Client owns the final produced video; a non-exclusive license is granted to the Studio for promotional use.
• Limitation of Liability: Our liability is strictly limited to a refund of monies paid minus expenses. We are not responsible for consequential or indirect damages.

9. ARCHIVING RESPONSIBILITY

The Studio does not permanently archive files. The Client is solely responsible for downloading and backing up all files immediately upon delivery.
